Consultation description
The Regulations set out the circumstances in which costs protection can be granted in eligible environmental cases and the level at which it can be made. It is proposed to make some adjustments to the scheme provided by the Regulations. The intention is to afford greater flexibility, clarity and certainty to the scheme within the framework of the relevant EU law requirements.
